Michael Jordan Tells Court He Felt No Fear of the Racing Body in Legal Battle

Michael Jeffrey Jordan, as he cordially introduced himself in a Charlotte court on Friday, stated that his competitive side and status as a newcomer emboldened his effort with 23XI Racing to confront Nascar over alleged violations of antitrust rules.

Team Investment and a Will to Win

Jordan shared financial and corporate details of his racing venture, revealing he invested $40 million of his own funds into the Nascar Cup series team launched with business partner Curtis Polk and driver Hamlin.

“Someone had to step forward,” Jordan said in the Charlotte courtroom. “As a newcomer, I wasn’t afraid. I believed I could take on Nascar as a whole. From my perspective, the sport required examination through a new lens.”

The Core Dispute: Franchise System and Contract Pressure

The heart of the case involves the expiration of a 2016 deal where Nascar provided each team a “charter”. The concept is similar to other professional sports with separately owned franchises, like the NBA’s Hornets or the Carolina Panthers. The agreement was due to end in 2024 when Nascar insisted on teams renew their charters.

Jordan was on the witness stand for an hour and exited the courthouse to pandemonium, with onlookers and reporters vying for a view or a picture of the global icon.

Spearheading the Fight

23XI Racing is at the forefront of the push along with Front Row Motorsports for Nascar to change a business model Jordan contended is breaking the law to keep two hands on the wheel.

At issue for Jordan and Heather Gibbs, who testified before Jordan, are details from last September. She recounted a hectic and tense six hours where the racing circuit told teams they must sign a charter agreement extension. This agreement consists of 112 pages outlining pay for chartered teams and a guaranteed entry in every race.

A Refusal to Sign

Jordan explained that his team and its ally decided their only feasible option was to refuse a signature that extensive document and take the issue to court. The other 13 organizations agreed to the terms.

Jordan and co-owner Denny Hamlin reached out to Nascar about potential amendments or negotiations. Nascar wasn’t talking, Jordan said.

The Ultimate Motivation: Victory

Ultimately, the resistance against what he saw as a financially unsustainable model was mostly about the usual bottom line for Jordan: Winning.

“Hamlin persuaded me adding a third car boosted our odds of winning,” he said, noting that he bought a third charter late in 2024 for $28m despite the uncertainty. “So I dove in.”

Heather Gibbs’ Testimony

Heather Gibbs detailed her request for permanent charters, submitted in a written letter to Nascar. She said the pressure of the signature deadline didn’t sit well.

She said, the team founder first attempted to call and persuade Nascar against forcing signatures, but Nascar’s leader declined the request.

“Don’t do this to us,” Gibbs recounted Joe Gibbs told Nascar’s leadership. The response was, “Whether I have 20 charters, I have 20. If there are 30, I have 30.”
